These Terms of Service are provided by MB “Nirista”, trading as Againora. Nothing in it limits rights that consumers have under mandatory law.

1. Seller identity and application

Againora is a trading name of MB “Nirista”, Mažoji bendrija (MB), a Lithuanian small partnership, registered in Lithuania under company code 305633468. Registered and correspondence address: Gedminų g. 2-121, LT-94167 Klaipėda, Lithuania. VAT number: LT100013455118. The entity is registered in the Register of Legal Entities of the Republic of Lithuania, administered by the State Enterprise Centre of Registers.

These terms apply to use of the Againora online store and consumer purchases made through it. They should be read with our Return and Refund Policy, Shipping Policy and existing Privacy Policy. If these terms conflict with a mandatory consumer-protection rule, the mandatory rule prevails.

2. Capacity to order

There is no product-specific minimum age. A purchaser must have the legal capacity to enter into the transaction or the permission required by applicable law. Information supplied at checkout must be accurate and sufficient to process payment and delivery.

3. Product information and pre-owned condition

Againora sells primarily one-off pre-owned clothing. Each item is normally available in a quantity of one. The product description and photographs form part of the contract and should disclose known condition issues and signs of wear. Measurements are approximate where applicable, and reasonable variations in colour display can occur between screens.

The pre-owned nature of an item does not remove statutory conformity rights. Disclosed signs of previous use or wear are not defects merely because an item is pre-owned, but undisclosed defects and differences from the listing remain covered.

4. Availability

Stock is allocated when an order is accepted. Because products are usually one-off, a simultaneous sale, inventory discrepancy or genuine unavailability can occasionally occur. If this prevents fulfilment, we will promptly inform you and issue a full refund. This is not a broad right to cancel accepted orders for arbitrary reasons.

5. Prices, VAT, shipping and import charges

The product price shown includes applicable VAT where required. Shipping charges are displayed separately at checkout before order submission. The store base currency is EUR; the order currency is shown at checkout.

Orders delivered within the EU customs territory and dispatched from Lithuania generally do not attract customs import duties.

United States orders are shipped Delivered Duty Paid (DDP). Againora covers applicable import duties, import taxes and customs clearance charges within the existing product prices and arranges their payment through the delivery provider. You pay no additional import charges at checkout or on delivery. The shipping charge shown at checkout still applies. If a carrier requests an import payment, contact support@againora.com.

For other destinations outside the EU customs or VAT territory, local import duties, import VAT and carrier fees may apply. Unless checkout expressly states that they are included or collected in advance, these charges are the customer's responsibility.

6. Payment methods

Use a payment method actually offered at checkout for your order and destination. Availability varies by market, device and payment provider.

7. Order placement and acceptance

You place an order when you complete checkout using the action that indicates an obligation to pay. The order becomes accepted when payment is successfully captured and Againora sends the order confirmation. The confirmation records the order details on a durable medium.

8. Cancellation before fulfilment

You may request cancellation before fulfilment or dispatch using your customer account or by emailing support@againora.com. Cancellation is possible where fulfilment handling has not progressed too far to stop the parcel. If the order can no longer be stopped, you may use the applicable withdrawal and return procedure after delivery. Statutory cancellation rights are not restricted.

9. Delivery and transfer of risk

Processing, dispatch, carriers, destinations, estimates and charges are described in the Shipping Policy. Againora remains responsible for loss of or damage to the goods until they are physically received by you or your designated recipient, except where applicable law provides otherwise because you independently chose a carrier not offered by Againora.

10. Withdrawal, returns and refunds

Againora's voluntary 30-calendar-day return period extends rather than replaces statutory rights. The EU right of withdrawal and the reimbursement process are explained separately in the Return and Refund Policy. You may use the electronic withdrawal function, the optional Model Withdrawal Form, or any other clear withdrawal statement.

11. Conformity and statutory remedies

Pre-owned goods supplied by a professional trader remain covered by statutory conformity rights, generally for two years from delivery under Lithuanian law. Depending on applicable law and the circumstances, remedies may include repair or replacement where possible and proportionate, price reduction, or refund and termination. Againora pays reasonable return costs for faulty, damaged, misdescribed or otherwise non-conforming goods.

Because most products are one-off, an identical replacement may be impossible. This practical limitation does not remove any legally applicable remedy.

12. Complaints

Submit a complaint in writing to support@againora.com or to MB “Nirista”, Gedminų g. 2-121, LT-94167 Klaipėda, Lithuania. We examine formal consumer complaints free of charge and provide a detailed, reasoned written response within 14 calendar days after receipt. 13. Liability

Each party remains responsible in accordance with applicable law. Nothing in these terms excludes or limits liability for deliberate misconduct, gross negligence, death or personal injury, mandatory consumer rights, or any other liability that cannot legally be excluded or limited.

14. Governing law and disputes

Lithuanian law governs the agreement. This choice does not deprive a consumer of mandatory protections available under the law of the consumer's habitual country of residence.

We encourage direct resolution first. If a dispute cannot be resolved, a consumer may contact the Lithuanian State Consumer Rights Protection Authority (VVTAT) and may use the Lithuanian Consumer Rights Information System (VTIS) where applicable. We do not link to the discontinued European Commission Online Dispute Resolution platform.

15. Changes and severability

The terms presented when an order is placed apply to that order, except where a mandatory legal change applies. If one provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.

Againora

We sell mainly second-hand clothing, alongside occasional new, unworn or deadstock items. The condition stated for each individual item applies. Label sizes and verified measurements are distinguished in the listing.

The store base currency is EUR. Supported market currencies are converted by Shopify; the currency and total shown at checkout are the currency and amount of the order. Your payment provider may apply its own conversion fees.
